Welcome to Autobiographer. These Terms of Service ("Terms") govern your access to and use of the Autobiographer website at autobiographer.io and related services (collectively, the "Service"), operated by trivialpursuits.dev ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Autobiographer is an AI-powered career tool that helps you create tailored job application materials. The Service analyzes job descriptions, parses your resume, and generates personalized taglines, summaries, cover letters, interview preparation materials, and fit assessments.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

You may use certain features of the Service without an account. To access all features, including saved resumes, story history, and monthly free allowances, you must create an account using Google OAuth or email authentication.

You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

4. Credits

4.1 Credits System

The Service uses a credits-based system for AI-powered features. Anonymous users receive 200 free credits per session. Registered users receive 1,000 free credits per month, which reset on the anniversary of account creation.

4.2 Earning Additional Credits

Users can earn additional credits through our referral program (3,000 credits per successful referral) and by providing feedback (1,000 credits per feedback submission). These "community credits" do not expire and are consumed after monthly free credits are exhausted.

4.3 Credit Costs

We reserve the right to modify credit costs for features at any time. Credits have no cash value and cannot be transferred or exchanged except as required by law.

5. User Content

5.1 Your Content

You retain ownership of all content you provide to the Service, including resumes, job descriptions, and custom instructions ("User Content"). By uploading User Content, you grant us a limited license to process, store, and display it as necessary to provide the Service.

5.2 Generated Content

Content generated by the Service (taglines, summaries, cover letters, etc.) is provided to you for your personal use. You own the generated content and may use it for job applications and related purposes.

5.3 Accuracy

You are responsible for reviewing all generated content for accuracy before use. The Service uses AI, which may produce errors, inaccuracies, or content that does not reflect your actual experience. We are not responsible for any consequences of using unreviewed generated content.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service without permission
• Resell, sublicense, or commercially exploit the Service
• Use generated content to misrepresent your qualifications
• Reverse engineer or attempt to extract source code

7. AI Limitations and Disclaimers

The Service uses artificial intelligence to generate content. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or inappropriate suggestions
• The Service does not guarantee job interviews, offers, or employment outcomes
• Generated content is a starting point and should be reviewed and customized
• We do not provide career counseling, legal, or professional advice
• AI analysis of job descriptions is interpretive and may not reflect employer intent

8. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by trivialpursuits.dev and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

9. Third-Party Services

The Service integrates with third-party services including Anthropic (AI processing), Google (authentication), Resend (email delivery), and others. Your use of these services is subject to their respective terms and privacy policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRIVIALPURSUITS.DEV BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless trivialpursuits.dev from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 10, 11, 12, 14, and 15 survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Alameda County, California, and you consent to personal jurisdiction in these courts.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

Amendments: We may modify these Terms at any time. We will notify you of material changes by posting updated Terms and changing the "Last Updated" date. Continued use constitutes acceptance.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver.

Assignment: You may not assign these Terms without our consent. We may assign our rights without restriction.
